Marriage Registration Procedure in Vietnam
If you are planning to register your marriage in Vietnam, it’s essential to follow the official procedures and prepare the required documents thoroughly. Below is a step-by-step guide:
1. Prepare Required Documents
The documents needed depend on whether you are a Vietnamese citizen or a foreigner:
a) For Vietnamese Citizens:
- Marriage Registration Application Form (provided by the Department of Justice).
- ID Card/Passport (copy certified by local authorities).
- Household Registration Book or Temporary Residence Certificate (certified copy).
- Certificate of Marital Status, issued by the local People’s Committee within the last 6 months.
- Divorce Certificate or Spouse’s Death Certificate (if applicable).
b) For Foreign Nationals:
- Passport (certified copy).
- Certificate of Marital Status, issued by the competent authority in the home country (legalized and translated into Vietnamese).
- Valid Visa or Temporary Residence Permit in Vietnam.
- Certificate of Mental Health (if required by the local authority).
2. Submit the Application
- Submit your complete application to the Department of Justice at the People’s Committee of the province or city where the Vietnamese partner resides.
- The authorities will verify the completeness of your documents and issue a receipt for your application.
3. Attend the Interview
- Both parties must be present for an interview conducted by the Department of Justice.
- The interview will focus on your relationship, communication methods, and future marital plans.
4. Document Verification and Approval
- The Department of Justice will verify your documents and may consult other relevant authorities if necessary.
- The verification process typically takes 15 working days but can take longer in complex cases.
5. Receive the Marriage Certificate
- Once the documents are approved, you will be issued a Marriage Certificate.
- Both parties must be present to sign the certificate at the Department of Justice.
6. Legalize the Marriage Certificate (If Required)
- If the foreign partner needs the marriage certificate for official use abroad, it must be translated into the required language and legalized at the Ministry of Foreign Affairs.
Important Notes:
- Ensure that all foreign documents are legalized and translated into Vietnamese before submission.
- Be prepared for additional requirements in special cases, such as a significant age difference or language barriers.
